IFICI Portugal: Real Success Cases for Tech Founders and Digital Nomads

One Year In — What We Know Now:

When Portugal closed the original Non-Habitual Resident (NHR) regime to new applicants at the end of 2023, a wave of uncertainty followed. Would the replacement — IFICI (Incentivo Fiscal a Investigação Cientifica e Inovação) — be as good? Would it actually work for tech professionals, founders, and digital nomads?

Over a year into its implementation, the answer is becoming clear. IFICI is not just a rebranded NHR — it’s a more structured, more selective, and in many ways more powerful regime. And the first full cycles of approved applications are now proving it.

At our firm, we’ve guided clients from the United States, United Kingdom, and Canada through successful IFICI applications. In this article, we share the patterns, the key decisions, and the architectural approach that made those cases work — because the success of IFICI always begins long before the application is filed.

What IFICI Actually Is (And What It Isn’t)

IFICI is Portugal’s tax incentive for new residents working in qualifying activities — primarily research, technology, innovation, and high-value services. It entered into force on January 1, 2024, and its implementing regulations were published in late December of that year, with the first formal application window opening in early 2025.

The core benefits are straightforward:

A flat 20% IRS rate applies to employment and self-employment income (Categories A and B) earned through qualifying activities in Portugal. Additionally, foreign-source income is largely exempt from Portuguese taxation — including employment income, dividends, interest, capital gains, and rental income from abroad. This combination creates extraordinary planning opportunities for internationally mobile professionals.

What IFICI is not is a blanket benefit for any remote worker who lands in Lisbon. The regime targets specific professional profiles and sectors. The single most important distinction from the old NHR: eligibility is now tied to your professional activity, not simply to your residency status. This means the application process is more technical — but the outcome, when structured correctly, is more defensible and often more valuable.

Who qualifies?

The regime covers a wide range of high-value profiles: tech executives and founders, software engineers, IT specialists, researchers, engineers and members of the management or technical teams of recognizes Portuguese startups, Entrepreneurs setting up operations in Portugal through qualifying companies – particularly those in export-oriented sectors or officially recognized innovation structures – are among the most common successful applicants we work with.

Three Success Cases From Our Practice

The cases below are composite examples drawn from real client profiles. We’ve adjusted identifying details for confidentiality. They illustrate the three most common archetypes we see — and the decisions that made each application succeed.

UNITED STATES – The US Founder Setting Up a European Hub

A software founder based in California came to us asking whether a move to Lisbon could make tax sense.

The answer was yes — but only because we structured it correctly. The key was establishing a Portuguese company that met IFICI’s eligibility requirements for qualifying employers. We coordinated the company setup, the immigration process (D8 visa transitioning to a residence permit), and the IFICI application as a single, coordinated workflow.

UNITED KINGDOM – The UK Tech Lead Relocating Post-Brexit

A senior engineering manager at a UK-based fintech company had been
exploring European relocation for two years. After his employer expanded its
Portuguese team, a transfer to the Lisbon office became viable.

The challenge: structuring the employment contract and employer confirmation to satisfy IFICI’s qualification criteria for the specific management role.

CANADA – The Canadian Consultant Structuring for IFICI

A Canadian web3 developer and consultant had no employer — just a portfolio of international clients. The old NHR had worked beautifully for freelancers like him. Under IFICI, the path is narrower but still navigable.

We set up a Portuguese single-member company (unipessoal) operating within a qualifying sector, with documented export turnover exceeding the required thresholds

This approach requires careful setup and ongoing compliance, but it works — and it’s repeatable for independent professionals with international client bases.

The Architecture of a Successful IFICI Application

The single most important insight from the cases above: IFICI success is not about filling in an application form correctly. It’s about designing the right structure from the moment you decide to move.

Here is the step-by-step framework we use with every client who is targeting IFICI
from abroad:

1-) Eligibility Assessment Before Everything Else

Before any immigration steps begin, we map your professional profile against the IFICI activity list and the qualifying company criteria. This determines which application track applies to you (AT, IAPMEI, AICEP, FCT, Startup Portugal) and what structure will be required.

2-) Designing the Immigration Pathway

Immigration and tax residency must be coordinated deliberately. The visa or residence permit you enter on, and the calendar year in which you become a Portuguese tax resident, directly affects your IFICI application timeline. We design the immigration route with the tax outcome in mind.

3-) Company & Employment Structure

For founders and freelancers, setting up the right Portuguese entity is critical. The company must meet sector, export, and activity criteria. We prepare the company structure, define the qualifying role, and document it for the relevant certifying body.

4-) NIF, Tax Residency & Enrollment

Once in Portugal, we manage NIF registration, tax residency enrollment, and the formal IFICI application — which must be filed by January 15 of the year following your first year of residence. For employers, we also coordinate the required employer confirmation through the AT portal.

5-) Ongoing Compliance & Annual Filing

IFICI requires annual maintenance: verifying that qualifying activities continue, managing IRS declarations under the regime, and monitoring foreign-source income treatment. We provide ongoing advisory to keep the benefit active for the full 10 years.

A note on timing: The standard IFICI application deadline is January 15 of the year following the year you become a Portuguese tax resident. Missing this window means waiting an entire additional year. Engaging an advisor before you arrive — not after — is not a luxury; it’s a necessity.

What About Digital Nomads?

This is one of the most common questions we receive — and it deserves an honest answer. Pure digital nomads with no professional ties to Portugal do not automatically qualify for IFICI under the straightforward reading of the regime. The benefit is linked to qualifying professional activity, not just presence in Portugal.

However, many digital nomads can qualify — if they establish the right structure. A tech consultant who incorporates a qualifying Portuguese company, generates export revenues, and takes on a formal role within that entity is functionally very different from someone who simply works remotely from a Lisbon café. The structure makes the difference.

If you’re currently on a D8 Digital Nomad Visa and exploring whether IFICI is accessible to you, the answer is: possibly yes, with the right planning. Speak with a qualified advisor before assuming you’re in or out.

Portugal’s Strategic Logic — And Why It Matters to You

IFICI is not accidental generosity. Portugal is deliberately competing for international talent in a global market. The country has built a serious tech ecosystem — Lisbon’s Web Summit, a robust startup community, EU membership, and a growing base of international companies — and IFICI is the fiscal expression of that strategy.

For professionals from the US, UK, and Canada, the proposition is compelling: a stable European base, world-class quality of life, access to the EU market, and a tax rate that can be significantly lower than what you’re paying at home. For a senior professional earning above a certain threshold, the annual tax saving alone can amount to six figures.

That’s not a coincidence. It’s by design.
